Comments: This one-day course is designed for LEO's
assigned to investigate juvenile delinquency
cases, involved in juvenile court delinquency
proceedings, and those who regularly encounter
juveniles.
This course employs lecture, class discussion and
an intensive review of appellate court cases
illustrating the objectives pertaining to
juveniles, such as: where cases are heard;
considerations for arrest procedures;
when may be transferred to superior court;
description of circumstances under which LEO may
take custody of without a court order;
constitutional and state statutory rights;
Miranda warnings by age; meaning of "custody"
for interrogation purposes under Miranda;
potential for false confessions; consent to
search and any limitations of that consent;
options of LEO when taking into custody;
factors that the court must consider in
deciding whether to secure or release;
notification that LEO must make; photographing
and fingerprinting statutes; how to obtain
and execute a Nontestimonial Identification Order;
and discuss recent statutory changes affecting
juveniles.
It is recommended that students bring the Sixth
Edition of Robert Farb's Arrest, Search and
Investigation in North Carolina. The book is
available at the NCJA bookstore

Comments: This class is for investigators and LEOs
involved with enforcement activities associated
with search warrants, warrantless searches,
interviews, eyewitness identifications and
nontestimonial identification orders and who are
subject to potential legal liability resulting
from those activities.
NOTE: Course participants must have successfully
completed the two-week Police Law Institute (PLI)
course two or more years ago. Students are
required to provide the PLI certificate of
completion prior to enrolling in this course.
Course Goal: To provide a legal update on the
skills necessary to conduct enforcement
activities associated with search warrants,
warrantless searches, interviews, eyewitness
identifications and nontestimonial identification
orders and to avoid liability while conducting
such activities.
Course Description: This course will review the
concepts covered in PLI. We will also cover recent
case law and statutory changes/interpretations.
Discussions will be of US and NC court opinions,
legislation updates affecting juvenile law and
other legal areas, and upcoming court decisions.
Areas of discussion includes search and seizure,
search warrants, interrogation law, and law of
arrest.
The student will be exposed to recent federal and
state case law and statutes concerning:
- Search warrants
- Warrantless Searches
- Interrogations
- Nontestimonial and eyewitness identification
procedures.
- Stop and frisk
Methodologies: This course utilizes discussion,
video scenarios, statutes, and case studies.

the "do's and don'ts" of police/citizen

digital evidence search warrant preparation

defend against a liability action in lawsuits
relating to search warrants.
Methodologies:
This course utilizes discussion, video scenarios,
practical exercises, programmed texts, student
readings and case studies.
Course Requirements:
Attendance is required at all class sessions.
The student must participate in class and
practical exercises, successfully prepare
search warrants and nontestimonial orders and
successfully attain a required score on a
written examination. Students are encouraged
to have a copy of the Arrest, Search and
Investigation textbook, written by Robert Farb
and published by the UNC School of Government
(Fifth Edition 2016).
Special Concerns
Readings and other assignments will need to be
completed in the student's evening hours.
